FINAL ELEMENTS ORDER
Once you are ready to order, send a list of clip or tape references, time codes and descriptions.We will provide the master material within 3 or 4 working days. In some cases, the footage can be delivered within 24 hours, depending on the source and origins of the material, or even within the same day for a clip download in broadcast quality. Final edit material is available for one use and one purpose only. Therefore all masters or film elements must be returned FILM IMAGES for storage at completion of production, without delay and at client's cost.
PURCHASE AND LICENSE REQUIREMENTS FOR RIGHTS-MANAGED COLLECTIONS
License rates for the rights-managed footage are set according to territory, use, duration and sometimes source of document. When asking for a quote please always specify whether you need television rights only, what you include exactly if « all media », and whether you need theatrical rights. Other specifications like territory, broadcastors, number of units in case of home video distribution, and language in case of internet use, can be of valuable help as well.
All the conditions listed above and below do not affect royalty free collections, that allow a multiple use at a one set price. When buying royalty free footage, a contract will be delivered by FILM IMAGES.
- Rights shall be granted exclusively for the mentioned production. The right to use this footage is non-exclusive and takes effect as of the first run or in the absence of the latter upon the signing of the Order Form / Contract.
- All orders of masters will be subject to a minimum flat fee. This sum is non-refundable in all cases, even when footage is not used in the final edit.
- The footage count (screen time) is calculated according to the actual quantity of footage used in the final version.
When invoice is per clip : a clip is defined by the real time duration of footage on screen. Segments that are from the same clip but shown separately in a production are considered as separate shots and are billed individually. Similarly, repetitions of the same segment of a clip within a production are each considered as a separate shot and are billed at 50 % of the initial rate.
When invoice is per minute : per indivisible minute and per source, with a one minute minimum and sometimes a maximum of six cuts per minute. - Within thirty days of delivery of a master, the total amount of footage used must be reported to FILM IMAGES along with a VHS copy of the completed production for the final edited version verification.
- All viewing cassettes and masters, whether the film or video material is included in the production or not, must be returned to FILM IMAGES without delay, at the cost of the client in order to protect rights and ownership of footage for which we grant a contract.
- The licensee acknowledges that use of footage may require, within the confines of professional agreements, the approval or authorization by parties other than the licensor, such as the legal claimant, professional guilds, or corporations. The licensee, if he so wishes, could obtain these above-mentioned additional rights, and these rights will be subject to an additional bill. In cases where the contractor is unable to obtain supplementary licensing, the licensee will have no further recourse in this matter. NB All clips taken from theatrical trailers must be clearly distinguishable from feature film clips by use of original graphics and/or original commentary. In addition, the producer is entirely responsible for the way in which the material is incorporated into the production.
- When video material ordered less than four days before completion of production, fifteen days in case of film elements, FILM IMAGES cannot be held responsible for any delay in supplying the material.
- The granting of rights will only take effect upon receipt of payment of all bills. Except in the case of TV commercials, FILM IMAGES must appear in the credits.
THE ORDER FORM AND ADDITIONNAL DOCUMENTS ARE TO BE DATED, INITIALED AND SIGNED BY FINANCIAL DIRECTOR AND RETURNED TO FILM IMAGES BY FAX. HARD COPY OF THE CONTRACT AND DEPOSIT OR TOTAL AMOUNT CHECK HAVE TO BE SENT UPON MATERIAL DELIVERY. REMAINDER PAYMENT HAS TO BE MADE UPON RECEPTION OF FINAL INVOICES.
